1. Acceptance of Terms
By accessing and using Prompting Workbench ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
These terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
2. Use License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your internal business purposes.
Permitted Uses
• Access and use the Service for legitimate prompt testing and optimization
• Create and manage prompts, versions, and test configurations
• Run tests against AI models through our integrated services
• Export and download your own data and test results
• Collaborate with authorized team members on your workspace
Restrictions
• You may not reverse engineer or attempt to extract the source code
• You may not use the Service to develop a competing product or service
• You may not resell, redistribute, or sublicense access to the Service
• You may not use automated systems or software to extract data from the Service
3. User Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.
Account Responsibilities
• Security: You must immediately notify us of any unauthorized use of your account
• Accuracy: You must keep your account information up to date
• Compliance: You must comply with all applicable laws and regulations
• Age Requirement: You must be at least 18 years old to create an account
4. Prohibited Uses
You agree not to use the Service for any unlawful purpose or any purpose prohibited under this clause. You agree not to use the Service in any way that could damage the Service, its providers, or the general public.
You specifically agree not to:

5. Intellectual Property Rights
The Service and its original content, features, and functionality are and will remain the exclusive property of Prompting Workbench and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without our prior written consent.
Ownership
• Our Property: All Service features, functionality, and content (excluding User Content) remain our property
• Your Content: You retain ownership of content you create, but grant us a license to use it for providing the Service
• Feedback: Any feedback you provide may be used by us without restriction or compensation
6. User Content
You retain ownership of all content you create, upload, or share through the Service ("User Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your User Content solely for the purpose of providing and improving the Service.
Content Guidelines
• You represent that you have all necessary rights to your User Content
• Your content must not violate any third-party rights or laws
• You are responsible for maintaining backups of your User Content
• We may remove content that violates these Terms without notice
7. Privacy
Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.
We are committed to protecting your privacy and handling your data in an open and transparent manner. The personal data that we collect and process depends on how you use our Service.
8. Disclaimers
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results obtained from the use of the Service will be accurate or reliable.
No Warranty For:
• The accuracy, reliability, or completeness of any content
• The Service meeting your specific requirements
• Uninterrupted or error-free operation
• Results from AI models or third-party services
• Security of data transmission
9. Limitations of Liability
To the maximum extent permitted by law, Prompting Workbench shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
Maximum Liability
Our total liability to you for any damages arising out of or related to these Terms or the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.
10. Indemnification
You agree to defend, indemnify, and hold harmless Prompting Workbench and its licensees, employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).
You will indemnify us for claims arising from:
• Your use of and access to the Service
• Your violation of these Terms
• Your violation of any third-party right
• Any User Content you post or share through the Service
11. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
Effects of Termination
• Your right to use the Service will cease immediately
• We may delete your account and all associated data
• You remain liable for any outstanding fees or charges
• Provisions that should survive termination will remain in effect
You may terminate your account at any time by contacting our support team. Upon termination, your right to use the Service will immediately cease.
12. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Any disputes arising from or relating to these Terms or the Service shall be resolved through the competent courts of Arnhem, the Netherlands, unless mandatory arbitration rules apply under Dutch law.
13. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

• Update to the "Last Updated" date at the top of these Terms
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
